BEFORE HONOURABLE MR. JUSTICE ANJAN MONI KALITA ORDER 01.12.2025 Heard Mr. T. Chakraborty, learned counsel appearing for the accused- applicant. None appears for the Forest Department. 2. This is an application under Section 482 of BNSS, 2023 has been filed by the accused-applicant, namely, Ansula Narzary, praying for pre-arrest bail in connection with OR No. PB/01/2025 under Section 39/49B/51 of Wild Life
Page No.# 2/3 (Protection) Act, 1972. 3. The aforesaid OR No. PB/01/2025 was instituted on the basis of a written complaint dated 22.02.2025 lodged by the informant, namely, Bimal Hasda, Fr-I of Panbaru Range, Panbari, Manas Tiger Reserve before Sub-Divisional Judicial Magistrate, Bijni, Chirang inter alia stating that on 21.02.2025 at about 11.00 AM an operation was started at Village Ayodhyapur under Harisingha PS, District-Udalguri and during raid, they detected 2 numbers of elephant tusks and arrested one accused namely, Sadhin Narzary and during interrogation, said Sadhin Narzary revealed the name of the accused-applicant. However, at that time, when the team searched for the accused-applicant, he escaped. 4. On receipt of the report, the aforesaid OR No. PB/01/2025 under Section 39/498/51 of Wild Life (Protection) Act, 1972 has been registered. 5. Vide an order dated 26.09.2025, a Coordinate Bench of this Court has already granted interim bail to the accused-applicant and the accused-applicant has already appeared before the I.O. on 15.102025. 6. The learned counsel for the accused-applicant further submits that he would be called by the I.O. for recording his statements. He however submits that in two other cases which were registered against the accused appellant, he had already granted bail by this Court. The learned counsel for the accused- applicant, therefore, submits that the interim bail should be made absolute as he is co-operating with the investigations. 7.
On considering the materials on record as well as the submissions made by the learned counsel and as the accused-applicant has already appeared before the I.O. in terms of the interim order dated 26.09.2025, this Court is of the considered opinion that the interim order dated 26.09.2025 be made absolute
