That, the Hon’ble Court may kind enough to issue on appropriate writ by directing the concerned respondent 2 authorities to take action against the respondent No. 4 in accordance with law. ii. That, the Hon’ble Court may kind enough to issue an appropriate writ by directing the concerned respondents authorities to recover from respondent No. 4 the amount of financial loss. Iii. Any other relief or relief(s) which this Hon’ble Court may think proper in view of the facts and circumstances of the case may also kindly be granted. 2. facts of the case in short of that the present writ petition has not been filed against any particular order but filed against the inaction of the respondent authorities in not recovering a huge amount of financial loss committed by the respondent no. 4 while working as Education Officer District Mahasamund in purchasing of furniture during the year 2010-11 and 2011-12 which was found substandard in an enquiry by three members committee and the respondent no. 4 was found responsible for the same while sending enquiry report to the respondent no. 2 the Enquiry Committee recommended recovery of Rs. 2,18,94,670/- from the respondent no. 4 along with others. The respondent no. 4 thereafter continuously given posting on higher posts instead of initiating department enquiry against him and recovering amount of financial loss to the government / tax payers. Hence this petition. 3. Learned counsel for the petitioner submits that an enquiry was conducted and the enquiry report was submitted to the respondent No. 2 in which the enquiry committee recommended recovery of Rs. 2,18,94,670/- from the respondent No. 4 and the same has not been done by the respondent No. 2 therefore, this writ petition seeking for the above relief has been claimed. 4. There is a writ petition has absolutely misconceived. The petitioner is relying upon some communication to suggest that the above stated amount 3 is to be recovered. It does not disclose as from whom the said amount has to be recovered. Respondent No. 4 has been arrayed though his designation not in personal capacity. On the basis of said enquiry report if any amount is to be recovered or not it is in the domain of the State, hence, this Court is not inclined to grant such relief as claimed. 5.
