CORAM :THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE RAVI CHEEMALAPATI DATE : 18th March 2025 P C : The petitioner/respondent herein purchased a parcel of land admeasuring Ac.0-79 cents situate in Sy.Nos.125/8, 126/58, 126/59, 126/60, of Asakapalli Village, Sabbavaram Mandal, Visakhapatnam District in an auction conducted by the appellants on
18.01.2005. Having failed to convince the appellants - A. P. State Financial Corporation Limited to execute a sale deed in his favour based upon the said auction, the petitioner preferred W.P.No.7784 of 2019, which was allowed by virtue of the judgment and order impugned, and a direction issued to the appellants to execute the registered sale deed in respect of the land in question in favour of the petitioner. 126/61 and 126/62
2 The direction came to be issued also based upon the statement made by the learned counsel for the appellant Corporation, who did not dispute the factum of the petitioner having purchased the parcel of land in the auction and also made a statement that the appellant Corporation was ready and willing to execute the registered sale deed in respect of the petitioner.

Be that as it may, having conceded before the learned single Judge that the Corporation was willing to execute the registered sale deed in favour of the petitioner, the present appeal is, in those circumstances, not maintainable in view of the ratio of the judgment of the Apex Court in S. Thilagavathy vs. State of Tamilnadu and others\ Even otherwise we do not see any reason for the reluctance of the appellants to execute a proper sale deed having received the entire amount, which was the value of the land determined. through the process of auction as early as in the year 2005.
