The petition/Appeal coming on for hearing, upon perusing the Petition and the grounds filed inv3JJPPOrf thereof and upon hearing the arguments Of Sri G SAI NARAYANA RAO Advocate for the Petitioner, PUBLIC PROSECUTOR (AP) for the Respondent and the Court made the following. -\-` I.i, ## THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM CRIMINAL PETITION NO.194 OF 2025 ORDER:- This Criminal Petition u-nder Section 480 and 483 of the BNSS, is filed seeking to enlarge the petitioner herein/A4 on bail in Crime No.15 of 2024 of Chintoor Police Station, registered for the offences punishable under Sections 20(b)(ii)(C) read with 8(c) of the NDPS Act. 2. Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the Respondent-State. 3. Perused the record. 4. Learned counsel for the petitioner contended that the petitioner herein is arrayed as accused only basing on the confession of co-accused. He further contended that no part of the contraband was recovered from the possession of the petitioner herein. 5. Learned Assistant Public Prosecutor contended that the petitioner is not having any previous antecedents in respect of NDPS offences. 6. On hearing learned counsel on both sides and on perusal of the record, it is seen that Al to A3 were arrested on 07.03.2024 and from their possession 25 Kgs of Ganja was seized and they were remanded to judicial custody. The present petitioner is A4 and he was arrested on 25.ll.2024. Except the confessional statement of the co-accused, there is no other material is brought on record by the investigation agency showing the complicity of the petitioner. lt is confirmed by the learned Assistant Public Prosecutor that the petitioner is not having a.ny previous antecedents in respect of NDPS offences. Therefore, r - -I+-9 this Court finds that further continuation of detention does not seem necessary. Hence, the prayer is granted. 7. In the result, this Criminal Petition is allowed with the following conditions: i) The petitioner herein/A4 shall be enlarged on bail on executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties of the like sum each to the satisfaction of the Special Sessions Judge For Trial of the cases under NDPS Act-Gum-I-Additional rSessions Judge, East Godavari District: Rajamahendravaram. ii) Petitioner herein shall mark his attendance before the Investigating Officer on lst and 15th of every month between 10.00 A.M. and 1.00 P.M. till filing of the charge sheet. iii) Petitioner herein shall make himself available for investigation by a police officer as and when required, and he shall not, directly or indirectly, make any inducement, threat or promise to any persons acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer. iv)He shall not indulge in similar acts of crime and shall duly attend the trial of the case. //TRUE COPY// sD/- M.pRABHAJ{ARA RAO AS Ss IEScTT: :T#F?€T:R€ARR For AO-lv .I.
