The present Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of the Applicants seeking quashing of the charge-sheet dated 25.08.2025, the cognizance and summoning order dated 03.11.2025, and the entire proceedings of Criminal Case No. 593 of 2025 (arising out of Case Crime No. 047 of 2025), “State vs. Abhishek Kumar Vardhan”, pending before the Court of learned Judicial Magistrate, Kashipur, Udham Singh Nagar. By the impugned proceedings, the Applicant has been summoned for offences punishable under Sections 109(1), 115(2), 333, 351(3) and 352 of the B.N.S., 2023. 5. Along with the present Application, a joint Compounding Application (I.A. No. 01 of 2025) has been filed stating that the parties have amicably settled their dispute. 6. Today, the Applicant is present in person and has been duly identified by Ms. Aishwarya Thapliyal, learned counsel. Respondent Nos. 2 and 3 are also present in person and have been duly identified by Mr. Abhishek Verma, learned counsel. 7. This Court has interacted with the Applicant as well as Respondent Nos. 2 and 3. During the course of interaction, all the parties have stated that they have resolved their dispute amicably and do not wish to pursue the matter any further. They have further stated that they have no objection if the Compounding Application is allowed. 8. Per contra, learned State Counsel has opposed the Compounding Application on the ground that some of the offences involved are non- compoundable in nature. 9. Having considered the submissions of learned counsel for the parties and upon perusal of the record, this Court is of the considered view that the dispute between the parties is purely personal in nature and has been amicably settled. In such circumstances, continuation of the criminal proceedings would serve no useful purpose and would amount to an abuse of the process of law. 10. Accordingly, in the interest of justice, the Compounding Application deserves to be allowed and the entire proceedings of Criminal Case No. 593 of 2025 (arising out of Case Crime No. 047 of 2025), “State vs. Abhishek Kumar Vardhan”, pending before the Court of learned Judicial Magistrate, Kashipur, Udham Singh Nagar, are liable to be quashed, qua the present Applicant only. 11. The Compounding Application (I.A. No. 01 of 2025) is, accordingly, allowed. The entire proceedings of the aforesaid criminal case are hereby quashed only in respect of the present Applicant. 12.
