2. At the request of this Court, Mr P S Lahkar, learned Additional Public Prosecutor has taken telephonic instructions from the OC of Nagaon Police Station, who has stated that the charge sheet in the matter has been submitted and at present, the vehicle is not required to be retained by the investigating authorities. The learned Additional Public Prosecutor has further submitted that as per instructions no process for confiscation of the vehicle has yet
Page No.# 2/2 been initiated although on the earlier occasions, the zimma has been rejected on the ground that confiscation may be required.
3. In that view of the matter, the petitioner shall now approach the concerned trial Court praying for zimma of the vehicle and on such application being made, the learned Trial Court shall allow the zimma of the vehicle to the petitioner on such terms and conditions as may be deemed fit and in accordance with law.
4. Criminal Petition stands disposed of.
