2025:JHHC:15968 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 6937 of 2024 ----- 1.Khiru Yadav, S/o Late ChhatruYadav 2.Tulsi Yadav @ Govind Yadav, S/o Late Prabhu Yadav Both R/o Vill- Basdharwa, P.O & P.S.- Koderma District- Koderma, Jharkhand .... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Avilash Kumar, Advocate For the State : Ms. Bandana Sinha, AddI. P.P. …...... 06/ 18.06.2025: Heard, learned counsel for the parties. 2. This is an application filed by the petitioners praying for grant of anticipatory bail under Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending their arrest for the offences under Section 126, 115(2), 74, 303/3(5) of B.N.S. in connection with Koderma P.S. Case No.180 of 2024, pending in the Court of learned Chief Judicial Magistrate, Koderma. 3. The allegation against these petitioners is that because of the land dispute there was assault. Though there is allegation against these petitioners they have assaulted the informant party, but the fact that cannot be lost sight of is that all the offences involved are punishable for period of seven years or less. 4. The learned A.P.P. considering the aforesaid fact has admitted that petitioners have complied with notice under Section 35(3) of BNSS and co- operating in investigation. Since the offence punishable is less than seven years and petitioners had already complied with notice under Section 35(3) of BNSS and co-operating in the investigation it clearly suggests that there is no apprehension of the petitioners being arrested. 5. Thus, this case is covered by the Hon’ble Supreme Court in the case of Satender Kumar Antil vs. Central Bureau of Investigation & Another, reported in (2021) 10 SCC 773. 6. Petitioners are directed to appear before the Court concerned, who will pass order as per the direction of the Hon’ble Supreme Court in the case of Satender Kumar Antil vs. Central Bureau of Investigation & Another, reported in (2021) 10 SCC 773. 6. Accordingly, the instant anticipatory bail application stands disposed of. (ANANDA SEN, J.) R.S./
