ORAL ORDER
Accused No.1 in S.C.No.44/2025 pending before the Court of III Addl. District & Sessions Judge Kolar arising out of Crime No.58/2024 registered by the Ooragum Police Station, KGF, for offences punishable under Sections 189(2), 189(4), 191(2), 191(3), 324(4), 352, 109, 190 of Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the B.N.S.), is before this Court under Section 483 of B.N.S.S. seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No. 58/2024 was registered by Ooragum Police Station, KGF for the aforesaid offences against Abhi and others based on the first information dated 07.11.2024 received from Smt. Divya wife of Sri. Abishek. During the course of investigation, the petitioner herein was arrested on 18.11.2024 and subsequently remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in S.C.No.44/2025

was rejected on 24.04.2025. Therefore, he is before this Court. 4. A perusal of the material on record would go to show that accused Nos. 1, 2 and 4 have been granted regular bail by this Court in Crl.P.No.1808/2025 disposed of on 15.04.2025. The allegation against accused Nos.1, 2 & 4 and the petitioner herein is similar. Considering the aforesaid aspect of the matter, I am of the opinion that the petitioner's prayer for grant of regular bail requires to be answered in the affirmative. 5. Accused Nos.1, 2 and 4 who have been granted regular bail by this Court in Crl.P.No.1808/2025 were persons with criminal antecedents and even the petitioner herein is said to be a person with criminal antecedents and therefore appropriate conditions needs to be imposed while granting bail to the petitioner. 6. District & Sessions Judge Kolar arising out of Crime No.58/2024 of Oorgaum Police Station registered for the offences punishable under Sections 189(2), 189(4), 191(2), 191(3), 324(4), 352, 109, 190 of B.N.S. subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without

permission of the said Court until the case registered against him is disposed off. f) The petitioner is directed to mark his attendance on every alternative Sunday between 10.00 a.m. and 01.00 p.m. before the Station House Officer, Ooragum Police Station, KGF, till the case registered against him is
