Chauhan, learned counsel for the petitioner. Also heard Mr. K.K. Parasar, learned CGC; Ms. A. Verma, learned standing counsel for the FT and Border matters; Mr. A.I. Ali, learned standing counsel for the ECI; and Mr. P. Sarmah, learned Additional Senior Govt. Advocate for the State respondent. 2. When the matter was previously listed on 08.12.2025, the learned CGC has produced a copy of instruction to the effect that the father of the petitioner, namely, Md. Fajar Ali, the declared foreign national was handed over to the BSF. 3. As per the list, the name of the father of the petitioner appears at Sl. No. 108 and he has been sent back to the Country of origin in the intervening night of 26-28 May, 2025 from the Area of Responsibility (AOR) of 89 Bn. BSF. 4.
Accordingly, having heard both sides, the matter is closed without prejudice to the right of the petitioner/declared foreign national to take such steps as they may be so advised. JUDGE JUDGE Comparing Assistant
