THESE PETITIONS, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S VISHWAJITH SHETTY - 3 - HC-KAR NC: 2025:KHC:20292 CRL.P No. 7335 of 2025 C/W CRL.P No. 7336 of 2025 ORAL ORDER Accused Nos.5 and 6 in Crime.No.133/2025 registered by Kodigehally Police Station, Bengaluru City for the offences punishable under Sections 109, 126(2), 351(3), 352 R/w 3(5) of BNS, 2023 are before this Court in these two petitions filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime.No.133/2025 was registered by Kodigehally Police Station, Bengaluru City initially for the aforesaid offences against Murali and others on the basis of the first information dated 25.04.2025 submitted by Smt. Mala W/o Munikumar. During the course of investigation, the petitioners were arrested on 26.04.2025 and subsequently remanded to judicial custody. 4. The bail application filed by the petitioners before the jurisdictional Sessions Court was rejected. FIR registered in the present case would go to show that the name of the petitioners is not found in the FIR. The material made available to this Court by the learned counsel for the petitioner would go to show that, accused No.1 in the FIR is the cousin brother of the injured victim. The allegation against the accused persons is that accused No.1, who had an ill-will against the injured, along with his friends i.e, accused Nos.2 to 5 had followed the injured victim in their motorbike on 25.04.2025 and at about 7.26 p.m, had assaulted him with iron rod and long and had caused injury. The allegation of assaulting the injured victim is found against accused Nos.1 to 4. 6. The wound certificate of the injured would go to show that, he had suffered four injuries and out of the same three injures are said to be lacerated wound and one injury is a crush injury on the left little finger. The injured victim was admitted to hospital on 24.04.2025 and subsequently was discharged on 28.04.2025 and his - 5 - HC-KAR NC: 2025:KHC:20292 CRL.P No. 7335 of 2025 C/W CRL.P No. 7336 of 2025 condition is said to be stable. Undisputedly, the petitioners who are aged about 19 years have no criminal antecedents. Under these circumstances, I am of the opinion that, the petitioners' prayer for grant of regular bail requires to be answered affirmatively. 7. Accordingly, the following: ORDER The Criminal Petitions are allowed. The petitioners are directed to be enlarged on bail in Crime.No.133/2025 registered by Kodigehally Police Station, Bengaluru City for the offences punishable under Sections 109, 126(2), 351(3), 352 R/w 3(5) of BNS, 2023, subject to the following conditions: a) The petitioners shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court - 6 - HC-KAR NC: 2025:KHC:20292 CRL.P No. 7335 of 2025 C/W CRL.P No. 7336 of 2025 unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE NMS
