Gokul Wife Of Prithviraj, Resident Of Village Shyamota, Tehsil And District Sawai Madhopur, Rajathan. 2. Hariya Son Of Prithviraj, Resident Of Village Shyamota, Tehsil And District Sawai Madhopur, Rajasthan. 3. Naresh, Son Of Prithviraj, Resident Of Village Shyamota, Tehsil And District Sawai Madhopur, Rajasthan. ----Respondents For Petitioner(s) : Mr. Arvind Sharma For Respondent(s) : HON'BLE MR. JUSTICE SUDESH BANSAL Order 20/09/2025 1. By means of filing instant criminal misc. petition, challenge was made by petitioner to the order dated 20.11.2020, whereby and whereunder, the Chief Judicial Magistrate, Sawai Madhopur, determined interim maintenance. Against this Order, petitioner already filed one SB Criminal Misc. Petition No.5325/2021, which was dismissed as withdrawn, vide order dated 10.09.2021, yet petitioner has filed present petition again on 05.08.2025. 2. This Court, prima facie, finds that filing of this petition, is in sheer misuse of process of the law, however, counsel for petitioner states that the present petition has again been filed in ignorance of filing of previous petition, challenging the same impugned order. [2025:RJ-JP:38762] (2 of 2) [CRLMP-5094/2025] 3. Counsel for petitioner seeks permission to withdraw this petition. 4. Taking into consideration the fact that in the present petition, notices have not been issued and proceedings have not been commenced yet, this Court grants permission to withdraw the petition. 5. Accordingly, the present criminal misc. petition is dismissed as withdrawn. 6. Stay application and other pending application(s), if any, stand disposed of. (SUDESH BANSAL),J Sachin/160
