The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita, has been filed to quash the orders dated 26.04.2022 and 17.02.2025 passed by Additional Chief Judicial Magistrate, Court No. 5, Agra in Case No. 1 of 2021, (State Vs. Mata Prasad) arising out of Case Crime No. 57 of 2021, under Sections 307, 147, 148, 149 of I.P.C., Police Station- Iradat Nagar, District- Agra, whereby cognizance/ summoning order and bailable warrant has been issued against the applicant. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ bail application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
