ORAL ORDER
The petitioner-accused Nos.4 and 5 who are facing trial for the offences punishable under Sections 468, 420, 504 and 506 read with Section 34 of IPC are before this Court seeking relief.
2. The prosecution alleging that the subject property belongs to the complainant. However, the accused Nos.1 to 3 by colluding with each other created fabricated documents and conveyed the suit property to accused Nos.4 and 5.

3. The complainant and accused Nos.4 and 5 are present before this Court. They have filed an application for compromise stating that they have settled the dispute among themselves and in terms of settlement the complainant has received a sum of Rs.4,00,000/- and executed a registered consent deed confirming the sale deed executed in favour of accused Nos.4 and 5. The complainant further states that she has agreed to withdraw all the allegations and has no objection for quashing the impugned proceedings insofar as it relates to accused herein.

Although the offences alleged are cognizable or non-cognizable given the fact that the parties have amicably resolved the disputes among themselves, it would be futile if the investigation is allowed since the probability of police filing the charge sheet is remote in view of settlement. Under such circumstances, the continuation of proceedings will be an abuse of process of law.
5. Accordingly, the following:
ORDER
(i) The petition is allowed.

(ii) The impugned FIR in Crime No.196/2024 registered by Anekal Police Station insofar as it relates to accused Nos.4 and 5 is hereby quashed.
(iii) I.A.No.1/2025 is allowed.
