Be registered. The applicant-petitioner has preferred the present petition against the judgment of conviction dated 10.05.2024 and order of sentence dated 13.05.2024, passed by learned Addl. Chief Judicial Magistrate, First Class, Court No.II, Shimla, H.P. (hereinafter referred to as ‘the trial Court’), in Complaint
No.346-3 of 13/12, titled Balak Ram Vs. Ramesh Chand and affirmed by learned Sessions Judge, Shimla, District Shimla, H.P. in Criminal Appeal No. 67-S/10 of 2024, titled Ramesh Chand Vs. Balak Ram, decided on 14.08.2024. The Revision Petition filed raises arguable points. Hence, the sentence in the case at hand, is ordered to be suspended, subject to the petitioner depositing 50% of the entire compensation amount, if not already deposited, before the trial Court within four weeks from today and also subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the learned trial Court, undertaking therein that petitioner will attend this Court as and when required and in case of dismissal of the revision petition, he will immediately surrender before the learned trial Court to receive the sentence. A copy of this order be sent to the learned trial Court with the direction that the report of compliance of this order be submitted to this Court within a period of six weeks.
