Umakanta is present before the Court physically. Similarly, Mr. A. Sachikumar, learned counsel for the respondent No.1 and Mr. R.K Umakanta, learned G.A for the respondent No.2 & 3 is also present before the Court physically. In this Miscellaneous case proceeding, the applicant has filed this present application under provision of Order 22 Rule 3 CPC for production of LR for impleading legal heir of the sole petitioner who expired on 21.05.2025 during the pendency of the writ proceeding and the same has also been indicated in this application. However, this application is supported with an affidavit of Takchelchangbam Hemanta Sharma and he has filed with an affidavit which is consisting of para Nos.1-4 whereas in para No.3 of this affidavit revealed as the statement made in the para No.1- 3 accompanying the present Misc. application are found to be truth to his knowledge and therefore, seeking for allowing this application as filed under provision of Order 22 Rule 3 CPC. Consequently, this Misc.application initiated by filing an application under provision of Order 22 Rule 3 CPC is hereby allowed in the interest of justice. Accordingly, the counsel for the applicant/petitioner be directed to carry out the amendment in the original petition proceeding that this applicant be arrayed for the LR of the deceased in the cause title. Accordingly, the counsel for the applicant/petitioner be directed to carry out the amendment in the cause title of the original petition and amended petition shall be submitted. A copy of this order shall be furnished to the respondents for the purpose of reference. Accordingly, the proceeding in MC(CRP(C.R. P. Art.227) No.62 of 2025 is hereby disposed of.
