1. The petitioner has challenged her order of posting dated 06.06.2025 (Annexure-P/2) and prayed for the following reliefs in the present writ petition :-
“10.1 This Hon'ble Court may kindly be pleased to call for entire records pertains to petitioner, in original from the Respondent No.1 to Respondent No.4, as also, the record pertains to Counselling dated 04.06.2025 and 06.06.2025. 10.2 That, this Hon'ble Court may kindly be pleased to set aside/quash the order bearing No. 6959/Est./U.U./2025, Jagdalpur dated 05.06.2025 (Ann.-P/1) whereby first round of counselling dated 04.06.2025 and transfer/posting order Ann.-P/7 dated 04.06.2025 has been cancelled/withdrawn. 10.3 That, this Hon'ble Court may kindly be pleased to set aside/quash the subsequent order Bearing No. 7027/Est.02/U.U./2025 Jagdalpur dated 06.06.2025 (Ann.-P/2) whereby services of the Petitioner has been transferred/posted to the new place of posting i.e. Government Girls Higher Secondary School Bakawand, Block-Bakawand District-Bastar. 10.4 That, this Hon'ble Court may kindly be pleased to restrain the Respondent No.3 & 4 in prefixing of period of relieving/joining as per their own wish, therefore this Hon’ble may kindly be pleased to quash/ set-aside the Ex-Parte relieving, if any, by virtue of above clause.”

Learned counsel appearing for the petitioner, would submit that the initially the petitioner, who is the lecturer (Chemistry), was posted vide
order dated 04.06.2025 from Higher Secondary School, Nianar, Block- Jagdalpur to Higher Secondary School, Turenar, Block- Jagdalpur immediately after passing of the order dated 04.06.2025, the entire process of counseling and posting orders of teachers dated 04.06.2025 has been cancelled by the District Education Officer, vide order dated 05.06.2025 (Annexure-P/1) and thereafter, another order dated 06.06.2025 has been issued whereby the petitioner has been posted from Govt. Higher Secondary School, Nianar to Govt. Girls Higher Secondary School, Block- Bakawand. Learned counsel for the petitioner would further submit that, on 30.06.2025, she obtained information from Higher Secondary School, Turenar that one post of lecturer (Chemistry) is lying vacant and since earlier she was posted there at Turenar School vide order dated 04.06.2025, she made a representation on 02.07.2025 to the District Education Officer cum District Level Rationalization Committee for her posting at Higher Secondary School, Turenar as the post is lying vacant and earlier she was posted there, but till date no any decision has been taken upon her representation. The Respondent No. 4/ District Level Rationalization Committee may be directed to take a decision on the representation dated 02.07.2025 within the stipulated time frame in view of the document (Annexure-P/9) issued by the Block Education Officer, Jagdalpur dated 30.06.2025.
3. On the other hand, learned counsel for the State though opposes on merits, however, he has no objection if such a direction is being given
4 to the Respondent No. 4 to decide the representation of the petitioner within the stipulated time frame.
4. I have heard learned counsel for the parties and perused the material available on record.
5. Considering the submission made by learned counsel for the petitioner, considering the issue involved in the present writ petition, the same is
disposed off directing the Respondent No. 4 to take a decision on the representation of the petitioner dated 02.07.2025 (Annexure-P/10), keeping in view the information disclosed by the Block Education Officer, Jagdalpur dated 30.06.2025 and also in view of the initial order dated 04.06.2025 within two weeks from the date of receipt of the copy of this order in accordance with law.
6. The petitioner is directed to produce the copy of this order within a week from today to the Respondent No. 4.
