(Oral) This petition has been filed under Section 528 of BNSS, 2023 seeking quashing of FIR No. 10 dated 05.01.2013 under Section 420 of IPC registered at Police Station Phillaur, District Jalandhar (Annexure P-1) along with all subsequent proceedings arising therefrom on the basis of compromise dated 08.05.2013 (Annexure P-2). Learned State counsel, at the very outset, on instructions from ASI Subhash Chander submits that petitioner has been declared as proclaimed offender by learned trial Court vide order dated 03.11.2014. Faced with the above, learned counsel for the petitioner wishes to withdraw the present petition and seeks liberty to file a fresh petition on the same cause of action after challenging the order declaring the petitioner as proclaimed offender. In view of the above, present petition stands dismissed as withdrawn with liberty as aforesaid.
