The present writ petition has been filed for issuance of direction upon the concerned respondent to remove the encroachment from the land appertaining to Khata No.157, Plot No.1119 situated at Village-Bhandaria, District-Garhwa measuring an area of 0.8 acre. 2. Mrs. Omiya Anusha, learned A.C. to A.A.G.-I-A refers to paragraph no. 10 of the counter affidavit filed on behalf of the respondent nos.2 to 6 which reads as under : “That it is humbly stated and submitted that a petition was presented by the Local villagers' stating there in that the said Rasta situated over Plot no.1119 encroached by local villagers namely Santosh Kuamr Keshri, Pramod Keshri and Amod Keshri. The matter was enquired by the respondent no. 4 who has appointed as Collector under Bihar Public Land Encroachment Act and ultimately on 01.03.2025 the encroachment of the subject land has been removed. It is also important to mention here that the petitioner Vigan Prajapati was also present at the time of removal of encroachment, he was, being fully satisfied from the removal of encroachment executed by the authorities, put his signature over the report submitted by the respondent no.6 to respondent no.4.” 3. Keeping in view the aforesaid statement made in the counter affidavit filed on behalf of the respondent nos.2 to 6, there is no need to proceed further in the present matter. 4.
