This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: “to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents 4 and 5 at the instance of the 6th respondent in contemplating to block passage portion of road margin site of Ac 0.58 cents covered by Sy.No. 78/9 in Lingapalem Village and Mandal of West Godavari District lying in between Eluru to Chinthalapudi state highway and petitioner's land covered by Sy.no. 78/8A of Ac. 1.67 cents and Sy.No. 78/8B of Ac. 1.68 cents of Lingapalem Revenue Village, as illegal, irregular, irrational, without any authority of law, voilative of Andhra Pradesh Revenue Board Standing Order 15. Andhra Pradesh Land Encroachment Act, 1905. Andhra Pradesh Panchayat Raj Act, 1994 and offends Articles 14, 19 and 21 of Constitution of India and consequently direct the respondents 4 and 5 not to block petitioner's passage nor assign any portion of said passage road margin land to 6th respondents... 2. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue appearing for the respondents. 3. The case of the petitioner is that, the petitioner herein is the absolute owner and possessor of agricultural land in Sy. No. 78/8A, admeasuring to an extent of Ac. 1.67 cents, and Sy. No. 78/8B, 3 admeasuring Ac. 1.68 cents, situated in Lingapalem Revenue Village. There is a road margin poramboke to an extent of Ac. 0.58 cents in Sy. No. 78/9 of Lingapalem Revenue Village, located between the petitioner's land and the State Highway. As the road margin lies between the petitioner's land and the road, it has been using by the petitioner as a passage for his ingress and egress to his land. However, without following the due procedure, respondent Nos. 4 and 5, at the behest of the 6th respondent, have initiated steps to block the said road margin which is in usage for his ingress and egress. 4. The learned counsel for the petitioner submits that after filing the writ petition, the respondents are not interfering with the peaceful possession and enjoyment of the subject land and they are not creating any hurdle what so ever for the petitioner with respect to his ingress and egress to his land. 5. In view of the said submission and admission on the part of the petitioner that, since there is no interference by the respondents, no further orders are necessary in this writ petition. Accordingly, the writ petition is closed as infructuous.
