HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 4842/2016 Sumeshta D/o Shri Ajeet Singh, aged about 20 years, R/o Village Ghotra Khalsa, Post Office Kunji, Teh- Bhadra, District Hanumangarh. Raj. ----Petitioner Versus 1. Union of India, Ministry of Science and Technology, Department of Science and Technology, Through S, New Delhi- 110016 2. The Director, National Institute Science, Technology And Development Studies Nistads Dr. K.S. Kris, New Delhi- 110012 3. The Board of Secondary Education, Rajasthan Through Secretary, Ajmer ----Respondents For Petitioner(s) : Mr. Vinod Goyal For Respondent(s) : Mr. Ashish Kumar with Mr. Digvijay Mr. Shiv Lal Meena with Mr. Nathu Lal Gurjar Ms. Madhu Meena JUSTICE ANOOP KUMAR DHAND Order 27/08/2025 1. By way of filing this writ petition, a prayer has been made for issuing a direction to the respondents for granting the benefit of the Scholarship for Higher Education (SHE) under the Innovation in Science Pursuit for Inspired Research (INSPIRE) Scheme. 2. Counsel for the petitioner submits that as per the marks secured by the petitioner in Class-XII, she was entitled to get the benefit of the aforesaid scholarship, hence she applied for getting (2 of 3) [CW-4842/2016] the benefit of the same in the month of September, 2013 by offline mode. Counsel submits that when the scholarship was not granted to the petitioner, she submitted an application under the provisions of the Right to Information Act, 2005 (for short, ‘the RTI Act’) whereby she came to know that she was supposed to submit an online application and thereafter the online application was submitted by the petitioner in the year 2014 for getting the benefit of the same. However, inspite of submitting both online and offline applications till date, no scholarship has been awarded to the petitioner, hence appropriate direction be issued to the respondents in this regard. 3. Per contra, counsel for the respondents opposed the prayer and submitted that the offline application submitted by the petitioner was accepted by the respondents, treating her as eligible to receive the scholarship but no email ID was provided by the petitioner in her offline application, hence an SMS was sent to the petitioner to complete the other formalities on the website of the respondents i.e. www. online-inspire.gov.in, but the petitioner has failed to complete the other necessary formalities, hence her case was not considered for the concerned scholarship. Counsel submits that in response to the RTI application submitted by the petitioner, all facts were intimated to her and thereafter in the year 2014 she applied for scholarship through online mode. Counsel submits that since the scholarship of the petitioner was pertaining to the year 2013, hence her case was declined. Counsel submits that there was no fault on the part of the respondent in refusing to grant the scholarship to the petitioner. (3 of 3) [CW-4842/2016] 4. Heard and considered the submissions made at bar and perused the material available on record. 5. Considering the arguments raised by counsel for the respondents and looking to the fact that when the offline application submitted by the petitioner was received by the respondents, an alert message was sent to her on the registered mobile number through SMS to complete the needful exercise on the website of the respondents. The petitioner has failed to do so within the stipulated time, hence her case was not considered for the grant of scholarship in the year 2013. Subsequently, the online application was submitted by the petitioner in the following year 2014, hence the petitioner’s case could not have been considered for grant of scholarship in the previous year. Thus, this Court finds no error on the part of the respondents which requires any interference of this Court. 6. The present writ petition stands dismissed, accordingly. Stay application and all pending application(s), if any, also stand dismissed. (ANOOP KUMAR DHAND),J Ashu/110
