Plot No.66, an extent of 462 Sq.ft, or 51.33-00 Square yards in Survey No 539, Horsely Hills, Kotavoor Village, B.Kothakota Mandal, Tamballapalle Pradesh, from the foot hill of Horsley Hill, which is illegal, arbitrary and also not restoring the water connection to the Petitioners House, which is illegal, arbitrary and also violation of Article 21 and 300-A of the Constitution of India and against Principles of natural justice and consequently direct the Respondents No. 2 to 6 to not to restrict the transportation of drinking water by tractors to the premises of the petitioners and also direct the Respondent Nos.5 and 6 to restore the water connection to the Petitioners premises and pass Chittoor District, Andhra lA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the Respondents Nos. 2 to 6 not to restrict the Petitioner from carrying drinking water to its premises i.e., vide Plot No.66, an extent of 462 Sq.ft, or 51.33-00 Square yards in Survey No: 539, Horsely Hills, Kotavoor Village, B.Kothakota Mandal, Tamballapalle, Chittoor District, Andhra Pradesh, i.e., from the foot hill of Horsley Hills and pass Counsel for the Petitioner; 1.SUBRAMANYAM DARABOINA Counsel for the Respondent{S); 1.GP FOR REVENUE 2.GP FOR TOURISM The Court made the following: ::ORDER:: Heard Sri Subramanyam Daraboina, learned counsel for the petitioner, Sri Y.Balaji, learned Government Pleader for Tourism for respondents 1, 5 3 and 6, and Sri Divya Teja, learned Assistant Government Pleader for Revenue for respondents 2 to 4. rd The grievance of the petitioner is that at the behest of the 3 respondent, the 4**^ respondent is restraining the petitioner from transporting drinking water to the petitioner’s premises i.e., Plot No.66 in Sy.No.539, Horsely Hills, Kotavoor Village, B.Kothakota Mandal, Tamballapalle, Chittoor District from the Foot Hill of Horsley Hill and the same is illegal and arbitrary. 2. Learned counsel for the petitioner would submit that the petitioner purchased Plot No.66 under a Registered Sale Deed vide Document No. 1633/2008 dated 04.07.2008. The petitioner got membership in Horsely Hills Cooperative Housing Society Limited. At the behest of the 3 respondent, the 4*'^ respondent is not allowing the petitioner to get drinking water at the petitioner’s premises from the Foot of Horsley Hill. The petitioner made a representation dated 08.09.2023 (Ex.P14) to the 4*'^ respondent, requesting to resume water connection. 3. rd Learned Government Pleader for Tourism and learned Assistant Government Pleader for Revenue would collectively submit that the 4 respondent is not interfering with the petitioner from getting water to her house from the Foot Hill of Horsley Hill. Learned Government Pleader for Tourism would submit that the representation made by the petitioner dated 08.09.2023 (Ex.P14), has been forwarded by the 4‘^ respondent to the 6"" respondent. The 6‘^ respondent will consider the representation and pass appropriate orders as per the Law within eight (08) weeks. 4. th Given the facts and circumstances, the writ petition is disposed of, at the admission stage, with the consent of both the learned counsel, directing the respondents 3 and 4 not to obstruct the petitioner to get the drinking water to the petitioner’s premises i.e.. Plot No.66 in Sy.No.539, Horsely Hills, Kotavoor Village, B.Kothakota Mandal, Tamballapalle, Chittoor District from the Foot Hill of Horsley Hill. The 6^*^ respondent shall consider the 5. 4 th representation dated 08.09.2023 (Ex.P14), made by the petitioner to the 4 respondent, forwarded to the 6^'^ respondent and pass appropriate orders strictly as per the Law within eight (08) weeks.
