Respondent (Hon’ble Shri Justice Sanjay Kumar Jaiswal) Order on Board 16/09/2025 By this appeal filed under section 378(4) of the Code of Criminal Procedure, the appellant is challenging the impugned judgment dated 07.04.2022 passed in Complaint Case (NIA) No. 769/2019 whereby the learned Judicial Magistrate, First Class, Bilaspur, Chhattisgarh acquitted the respondent/accused of the charge under section u/s 138 of the Negotiable Instruments Act, 1881. No one appears on behalf of the appellant when the matter is 2 called out even in second round. On previous occasion also when the matter was taken up for hearing on 04.09.2025, no representation was made on behalf of the appellant. Since no one appears on behalf of the appellant despite repeated calls, this Court is left with no other way except to dismiss the appeal for want of prosecution.
