[2025:RJ-JP:3257] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 321/2025 Manohar Vishnoi, S/o Poonaram, Aged About 23 Years, R/o Champa Dhani, Village Dungarpur, Police Station Rohat, District Pali (Raj.) Presently Confined At Central Jail, Jaipur. ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Suresh Khileri For Respondent(s) : Mr. N.S. Dhakar, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 22/01/2025
1. The instant bail application has been filed under Section 483 of BNSS, on behalf of the petitioner, who has been arrested in connection with FIR No.0056/2024 registered at Special Police Station (SOG), District Jaipur (A.T.S. and S.O.G.) for the offences punishable under Sections 420, 467, 468, 471 and 120-B of IPC and Sections 3, 4, 6 & 10 of Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act,
2022. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. Counsel submits that co-accused Aditya Yadav who allegedly tried to get appointment on the post of Assistant Engineer on the basis of forged degree has been granted bail by this Court vide order dated 28.11.2024. Counsel submits that petitioner has nothing to
[2025:RJ-JP:3257] (2 of 3) [CRLMB-321/2025] do with the alleged offence and only allegation against the petitioner is that he received some money in his account. Counsel further submits that there are no other criminal antecedents of the petitioner. Petitioner is in custody since 19.11.2024. Charge-sheet has already been filed in this matter and trial of the case will take considerable time. Further custody of the petitioner would not serve any fruitful purpose. 3. Learned Public Prosecutor opposes the submissions made by counsel for the petitioner. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case, especially that fact that co-accused Aditya Yadav has been granted bail by this Court; absence of criminal antecedents of the petitioner; charge-sheet has been filed in this matter as well as looking to the custody period, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application. 6.
This bail application is accordingly allowed and it is directed that accused-petitioner- Manohar Vishnoi, S/o Poonaram, shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned Trial Court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. [2025:RJ-JP:3257] (3 of 3) [CRLMB-321/2025]
7. The observation made hereinabove is only for the purpose of deciding this bail application and shall not have any impact on the trial of the case. (ANIL KUMAR UPMAN),J LALIT MOHAN /247
