[2025:RJ-JP:32552] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 12067/2025 Dr. Ranjan Maheshwari S/o Shri I.L. Maheshwari, Aged About 59 Years, R/o 1002, Elanza, Rawatbhata Road, Kota (Raj.) ----Petitioner Versus 1. State of Rajasthan through Joint Secretary, Technical Education Department, Government of Rajasthan, Secretariat, Jaipur (Raj.) 2. Rajasthan Technical University, Through its Registrar, Kota (Raj.) 3. Vice Chancellor, Rajasthan Technical University, Kota (Raj.) 4. Nodal Officer, Search Committee of VC, RTU, Kota, Central University of Rajasthan, Kishangarh, Ajmer (Raj.) ----Respondents For Petitioner(s) : Mr. Naved Rafiq For Respondent(s) : Mr. Sarthak Rastogi with Mr. Tushar Kumar HON'BLE MR. JUSTICE MANEESH SHARMA Order 19/08/2025 1. Counsel for the petitioner submits that despite the direction issued by this Court in SB Civil Writ Petition No. 11916/2018 on 28.08.2018 to conclude the inquiry within three (3) months, the inquiry has still not been concluded. 2. He further submits that the issue of pay fixation on the post of Professor, as admissible with effect from 07.08.2009, is sub judice. Yet, the respondent, despite being fully aware of the pending legal proceedings, has not taken any remedial or interim step to protect the petitioner's professional and constitutional [2025:RJ-JP:32552] (2 of 3) [CW-12067/2025] rights. Therefore, he has filed the present writ petition seeking the following reliefs:- "(i) by issuing an appropriate writ, order ог direction in the nature thereof, direct Respondents to allow the Petitioner the to participate and to submit the online / offline application form for appointment on the post of Vice Chancellor, Rajasthan Technical University, Kota in pursuance of advertisement dated 07.07.2025 (Annexure-14) on provisional basis considering him eligible with requisite experience on the post of Professor subject to final disposal of the present Writ Petition; or (ii) by issuing an appropriate writ, order direction in the nature thereof, directing the Respondents that, if the Petitioner otherwise found suitable for appointment on the post of Vice Chancellor in pursuance of advertisement dated 7.7.2025, he may not be deprived from appointment only due to non-fixation of his pay in the pay scale of Professor" 3. Heard. 4. Heard. 4. Admittedly the prayer sought for in the present writ petition and stay application is dependent upon the final outcome of the writ petition No.6448/2019, therefore, until and unless the said writ petitions are heard and decided in favour of the petitioners, the petitioner cannot be held eligible for appointment to the post of Vice-Chancellor in pursuance of the advertisement dated 07.07.2025. 5. A bare perusal of the advertisement dated 07.07.2025 clearly reflects that the petitioners are otherwise not eligible to apply for the post of Vice-Chancellor. 6. In that view of the matter, the prayer made in the writ petition cannot be granted to the petitioner. 7. Therefore, the arguments raised by learned counsel for the petitioners cannot be accepted. [2025:RJ-JP:32552] (3 of 3) [CW-12067/2025] 8. Accordingly, the present writ petitions, being devoid of merit, are hereby dismissed. 9. All pending application(s), if any, stand disposed of.
