Respondent/s BEFORE HON’BLE MR. JUSTICE A. GUNESHWAR SHARMA Order 19.09.2025 [1] Heard Mr. Ajoy Pebam, learned counsel for the petitioner and Mr. Th. Sukumar, learned G.A. for the State respondent. [2] The petitioner approached this Court inter-alia praying for setting aside the NIT dated 29.08.2025 issued by the JNIMS, Porompat, Imphal East calling for tender for engaging security agency in JNIMS for a period of one year. [3] As per the NIT with bid document, bid end date/time is 09.09.2025 17:00:00 hours and bid opening date/time is 09.09.2025 17.30.00 hours. [4] The main ground for challenge is that in the lists of documents to be enclosed, 10 (ten) documents are enumerated. However, it is pointed out that for running business of private security agency, Section 4 of the Private Security Agencies (Regulation) Act, 2005 contemplates that no person shall carry on or commence the business of private security agency unless he holds a license issued under this Act. Home Department is the competent authority for issuing a license for engaging in the business of private security. [5] The petitioner has been issued a license for engaging in the business of private security agency under the Act of 2005 by a license dated 24.05.2022 issued by the Special Secretary (Home), Government of Manipur and the same is valid up to 23.05.2027. [6] During the course of hearing, Mr. Ajoy Pebam, learned counsel for the petitioner, submits that writ petition may be disposed of on the basis of the prayer No. (iv) to the extent that the State respondent be directed to include the license as one of the conditions for submitting bid in the NIT and the petitioner may be allowed to submit fresh bid. [7] Mr. Th. Sukumar, learned G.A. for the State respondent, submits that bid has already been closed. However, the respondents may be given one week’s time to incorporate the condition for having a license under Section 4 of the Private Security Agencies (Regulation) Act, 2005 in the NIT dated 29.08.2025. [8] In order to do justice and parity to those all who have already submitted bid, they may also be permitted to submit license under Section 4 of the Act of 2005. [9] This Court has considered the submissions made at the bar and the limited prayer of the petitioner. [10] In the circumstances, writ petition is disposed of by directing the State respondent to include the condition of license under Section 4 of the Private Security Agencies (Regulation) Act, 2005 as one of the documents to be annexed with the bid as 11th condition in addition to 10 (ten) already issued by the respondents. [11] One week’s time is granted for doing the needful. Further, one week’s time to the petitioner and others apply afresh. The applicants who have already submitted bid in terms of the earlier notice are also permitted to update their licenses. Other eligible aspirants are also permitted to submit their bid within the extended time fixed by the State authority. [12] With this observation, writ petition is disposed of.
