Order 12/09/2025
1. By way of filing this writ petition, a challenge has been led to the impugned order dated 22.07.2025 passed by the Board of Revenue by which the revision petition submitted by the respondents against the impugned order dated 05.02.2024 passed by the Sub-Divisional Officer has been allowed and the order dated 05.02.2024 has been quashed and set-aside and the matter has been remanded back to the Sub-Divisional Officer for passing
[2025:RJ-JP:37161] (2 of 2) [CW-12068/2025] fresh order within a period of three months after hearing the
arguments of both sides.
2. By passing the impugned order dated 05.02.2024, an interim
order was passed by the Sub-Divisional Officer directing the parties to maintain status quo with respect to the subject land. It appears that the stay application submitted by the petitioner is still lying pending for its adjudication on merits and the Revisional Court has directed the Sub-Divisional Officer to decide the same expeditiously preferably within a period of three months, after hearing the arguments of both sides. This Court finds no illegality in the order impugned passed by the Board, hence, the instant writ petition stands disposed of reiterating the same direction issued by the Board and it is expected from the Sub-Divisional Officer to decide the pending application expeditiously, as early as possible preferably within a period of six weeks from the date of receipt of certified copy of this order, after hearing the arguments of both sides.
3. With the aforesaid observation, the instant writ petition stands disposed of. All pending application(s), if any, also stand
disposed of.
