ORAL JUDGMENT (PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA)
Heard learned advocate Mr. Hiremath Jagadish Darukaswamy for the complainants and learned advocate Mr. K. Murthy for the respondent. 2. While disposing of the criminal petitions, learned Single Judge by the order dated 03.08.2023 inter alia, directed the petitioner-respondent to pay a sum of Rs.30,000/- per month to the respondents-complainants which will be the interim arrangement subject to any orders passed in Criminal Miscellaneous No.77 of 2021 and Criminal Miscellaneous (DVA) No.17 of 2021. 2.1 It was observed that the said amount of Rs.30,000/- to be paid monthly would include the rent of accommodation of the respondents. The petitioner was directed to pay the said interim maintenance from the month of August, 2023 onwards, till any interim order or final order of maintenance is passed in the said two

cases pending before the court below. The court also directed the court below to dispose of the petition filed under Section 125 of Code of Criminal Procedure (Cr.P.C) by the respondent-wife within six months. 3. It is the aforesaid direction which was brought under the contempt jurisdiction of this court by filing the present contempt petition. 3.1 The present proceedings witnessed filing of pleadings by both the sides from time to time. Finally, affidavit is filed by the respondent giving the details of the payment made by him to the complainant-wife till March 2025. Giving the list of payments, the following was stated in the affidavit,
"a. I. Pluxee Food card which is eligible upto Rs.2,200/- per month. My wife using it from the beginning, 19 months x 2200 Rs.4,180/- Totally Rs.5,75,521/-
3.2 Thus, Rs.5,75,521/- in total is paid by the respondent. There is a dispute about the calculation between the parties. 3.3 The case of the respondent-husband is that excess payment is made whereas, the case of the petitioner-wife is otherwise. 4. When the above payment of Rs.5,75,521/- is made, substantial compliance is obtained. In that view, the contempt petition is liable to be disposed of. 4.1 Final liability of the petitioner shall be worked out in the proceedings pending before the court below and the amount paid shall be adjusted. 5.
