Neutral Citation No. - 2025:AHC:33062-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 511 of 2025 Petitioner :- Chainpal Singh Chouhan Respondent :- State of U.P. and 4 others Counsel for Petitioner :- Alok Kumar Gupta, Arun Kumar Srivastava Counsel for Respondent :- Archana Singh, Jagdish Pathak (S.C.) Hon'ble Arun Bhansali, Chief Justice Hon'ble Kshitij Shailendra,J.
1. This petition in public interest has been filed by the petitioner seeking a direction to the respondents to close down the unrecognized schools which are running in bulk in whole U.P. and who have not completed the norms and standards specified in the Right of Children to Free and Compulsory Education Act, 2009 (for short 'the Act') and to appoint Prosecution Officer for sanctioning the prosecution as specified under Section 36 of the Act.
2. Though, it has been indicated that petition of similar nature is not pending consideration before this Court, however, counsel for the petitioner points out that in Public Interest Litigation (PIL) No. 542 of 2024 filed by one Iddu at Lucknow, a detailed order has been passed by the Bench at Lucknow, wherein authorities have been directed to submit reply regarding running of unrecognized schools in the State of U.P. and the action taken by the State authorities against such schools.
3. Once on an identical subject matter, another petition is pending before the Bench of this Court wherein cognizance has been taken pertaining to entire U.P., we do not find any reason to independently entertain this petition which is likely to result in passing of some conflicting orders.
4. In view thereof, the present petition is disposed of. The petitioner would be free to seek redress in the pending writ petition at Lucknow.
