Respondent(s) For Appellant (s) : Shri S.P.Sahu, Advocate For Respondent No.3 : Shri Saurabh Sahu, Advocate 2 ({Hon’ble Shri Justice Sachin Singh Rajput}) Order on Board 10/09/2025 Challenge in this appeal is to an award dated 09/05/2024 passed by the 1st Upper Motor Accident Claims Tribunal, Raipur, (CG) in Claim Case No.1015/2021, by which by the impugned award, against a claim of Rs.25,80,000/-, learned Tribunal has awarded compensation of Rs.9500/-. 2. Learned counsel for the appellant submits that the amount of compensation is on the lower side. Medical bills have not been considered. Amount on all other heads is also on the lower side. 3. Learned counsel for the respondent No.3 submits that the medical bills which have been placed on record has already been reimbursed from the Ayushmaan Card and he has not suffered any permanent disablement as the doctor was examined, therefore just compensation was awarded. 4. Reimbursement of the medical bills of the appellant from the Ayushmaan Car is disputed by the appellant claimant and he could not dispute the no disability was caused neither any doctor was examined. 5. Therefore, this Court is inclined to award additional amount of Rs.25,000/- in favour of the appellant / claimant in addition to the amount already awarded. Respondent No.3 shall pay the amount of Rs.25,000/- within a period of 60 days with 6% interest from the date of claim application. The appeal is allowed in part.
