These anticipatory bail applications under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, have been preferred by the petitioners apprehending their arrest for offences registered under Sections 420, 406, 467, 468, 120B of the Indian Penal Code. 3. The allegation against the petitioners is that the informant had given Rs. 20 lacs and odd to these petitioners for investing the same in the share market and to give him an appropriate proper return. It is alleged that the petitioners have defalcated the said amount. 2025:JHHC:16484 2

During course of argument, the learned counsel for the petitioners submitted that they have refunded the amount to which the informant opposed and submitted that he had invested Rs. 20 lacs and odd and out of which only Rs. 13 lacs have been refunded and it was agreed that Rs. 33 lacs was to be refunded. Thus, Rs. 20 lacs is still dues. 5. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 6. Considering the nature of the allegation and the fact that Rs.
13 lacs as per the informant has already been returned by the petitioners and it is case of the informant that some amount still dues, prima-facie, this Court is of the opinion that this case relates to recovery of amount, thus, this Court finds it a fit case for grant of anticipatory bail to the petitioners. 7. Accordingly, these Anticipatory Bail Applications stands allowed. The petitioners, above named, are directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of their surrender or arrest, they shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each, to the satisfaction of learned J.M. 1st Class, Jamshedpur, in connection with Sonari P.S. Case No.100 of 2024, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the Trial Court indicating his/her share in the property. 8. Further, both the petitioners will appear once in 15 days before the investigating officer and cooperate with the investigation till the Final Report is submitted. (ANANDA SEN, J.) Tanuj/Cp-3
