1.GP FOR SERVICES I The Court made the following:
2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 19590/2025 The present Writ Petition is filed to declare the action of the Respondents in not regularizing the services of the Petitioner with effect from 25.11.1993 while regularizing the services of similarly placed employees as illegal and arbitrary. 2. The facts leading to filing of the present Writ Petition are as follows: The Petitioner claims to have been appointed as N.M.R in the Respondent No.3 Corporation i.e., the Greater Visakhapatnam Municipal Corporation in the year 1982 and had been discharging her duties diligently since then. While so, 63 employees of Respondent No.3 Corporation, who were similarly placed, had filed O.A.No.8678 of 2011 before the then Andhra Pradesh Administrative Tribunal (APAT) seeking for regularization of the their services with effect from 25.11.1993 in terms of G.O.Ms.No.212, dated
22.04.1994. The Tribunal, vide
Order dated 08.11.2011, passed orders directing for regularization of the above 63 applicants with effect from 25.11.1993 in terms of G.0.1Vls>No.212, dated 22.04.1994 by placing reliance on a
3
judgment of the Hon’ble Apex Court in the case of District Coilector/Chairman and Others v. M.L.Singh and others\ Pursuant to the
Order of the Andhr*a Pradesh Administrative Tribunal, all the above 63 applicants were said to have been regularized by the Respondent Corporation vide G.O.R.T.No.252 dated 14.02.2014.
3.
Learned counsel for the Petitioner submits that the Petitioner is also on the same footing as that of the applicants in O.A.No.8678 of 2011, and therefore, he seeks for extension of a similar benefit of regularization to the Petitioner.
4. Learned Standing Counsel seeks time to file Counter Affidavit. Having heard the respective counsel and considering the
5. fact that the Petitioner is said to be in employment from the year 1982, rather than waiting for the Counter Affidavit by the Respondent, this Court is of the opinion that the present Writ Petition can be disposed of with the following directions: 2009(8) see 480
4 (i) The Petitioner shall submit the representation to the Respondent Corporation within a period of four weeks from the date of receipt of a‘ copy of this Order along with Service Particulars and necessary documents to establish her claim for regularization; and (ii) The representation of the Petitioner shall be considered by the Respondent Corporation as expeditiously as possible preferably not beyond three months from the date of receipt of the representation by the Petitioner.
