ORAL ORDER
Accused Nos.4 and 5 in Crime No.54/2025 registered by Ramapura Police Station, Chamarajanagara District, for the offences punishable under Sections 4 and 5 of Explosive Substances Act, 1908, Sections 9(B) and 1(b) of the Explosives Act, 1884 and Section 325 of BNS 2023 are before this Court under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail.
2. Heard the learned counsel for the parties.
3. F.I.R. in Crime No.54/2025 was registered by Ramapura Police Station, Chamarajanagara District, against unknown persons for the aforesaid offences on the basis of first information dated 31.03.2025 received from Muruga s/o Doddakala. During the course of investigation of the case, the petitioners herein were arrested on 03.04.2025 and in their remand application, they were arraigned as accused Nos. 1 and 2.

4. The bail applications filed by the petitioners in Crl.Misc.No.5060/2025 before the jurisdictional Sessions Court was rejected on 19.04.2025. Therefore, they are before this Court.

Learned counsel for the petitioners submits that allegations against accused Nos.1 and 2 and petitioners herein are similar. Accused Nos.1 and 2 have been granted regular bail by this Court in Crl.P.No.6515/2025,
disposed of on 02.05.2025.
6. Per contra, learned HCGP who has opposed the bail petition does not dispute the submission made by the
learned counsel for the petitioners.

Perusal of the material available on record would go to show that allegations against the accused Nos. 1 and 2 and petitioners herein who are arraigned as accused Nos. 4 and 5 in the FIR are similar. Accused No.3 who was arrested in the present case has been granted regular bail by the jurisdictional Sessions Court in

Crl.Misc.No.5065/2025 and accused Nos.1 and 2 have been granted regular bail by this Court in Crl.P.No.6515/2025.
8. Under the circumstances, I am of the opinion that prayer made by the petitioners for grant of regular bail needs to be answered affirmatively on the ground of parity.
9. Accordingly, the following:
ORDER The Criminal Petition is allowed. The petitioners are directed to be enlarged on bail in Crime No.54/2025 registered by Ramapura Police Station, Chamarajanagar District, for the offences punishable under Sections 4 and 5 of Explosive Substances Act, 1908, Sections 9(B) and 1(b) of the Explosives Act, 1884 and Section 325 of BNS 2023, subject to the following conditions:

a) Petitioners shall execute personal bond for a sum of Rs.1,00,000/- each (Rupees One Lakh only) with two sureties each for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future;
