KALAVA SURESH KUMAR REDDY ( SC FOR MC RAYAL REGION, NELLORE) The Court made the following: 2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.11163 of 2013 ORDER: The present Writ Petition is filed seeking for the following relief: “to declare the action of the 4th respondent in threatening to demolish the shops situated at Arora Colony, Kurnool Town, without issuing any notice and without following the due process of law while the applications of the petitioners for issuance of house site pattas is pending consideration before the revenue officials as being illegal, arbitrary, unjust and unconstituional and consequently direct the respondent No 1 to 3 to issue the pattas to the petitioners in respect of their plots in their possession and occupation”. 2. The Petitioners claim to have been in possession of small extents of about one cent each in Sy.Nos. 735 and 736-A abutting the SuddaVagu at Arora Colony, Kurnool, for more than 15 years and as there was threat of dispossession, the present Writ Petition was filed. 3. This Court vide Order dated 15.04.2013 granted interim order as under: 3 “There shall be an interim direction not to demolish the Petitioners’ houses without following due process of law”. 4. In view of the facts and circumstances of the case and as stated by the learned counsel appearing for the Respondents that as no further adjudication, on facts, is required in this matter, the respondents are directed to follow the interim order granted by this Court on 15.04.2013. 5. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
