ORDER:
The present writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
“...to issue a writ, order or direction more particularly one in the nature of mandamus, declaring the action of the Respondent Nos.2 to 3 in not considering the petitioner’s application No.MLPM241029031482 dated 29.10.2024 submitted to Respondent No.3 as illegal, arbitrary and amounts to abdication of statutory duties cast up on them and also violative of Articles 14 and 21 of the Constitution of India and consequently direct the Respondents 2 to 3 to issue pattadar passbook in the name of petitioner for the extent of Ac 1.681 cents in Survey No.257 and 258-B, extent of Ac 0.55 cents in Survey No.141 and extent of Ac 0.78 cents in Survey No.142 in Chandavarm Village, Nadendia Mandal, Palnadu District previously Guntur District, Andhra Pradesh and pass such other
order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.”
2. Learned Government Pleader has furnished the written instructions, dated 23.07.2025, of 3rd respondent/Tahsildar, wherein the relevant portion of the instructions is hereunder.
“3. In this connection, I submit that, the petitioner Sri Daggubati Venkateswara Rao, S/o.Ankamma Rao filed an application in Village Sachivalayam vide application No.MLPM241029031482, dated 29.10.2024 for mutation of his name in revenue records for the land to an extent of ac.1.681 cents in L.P.No.3395 (Old Sy.No.257, 258-B), Ac.0.78 cents in L.P.No.1350 (Old Sy.No.142) and Ac.0.55 cents in L.P.No.1347 (Old Sy.No.141) situated at Chandavaram Village of Nadendla Mandal. After due procedure, the application filed by the petitioner was accepted on 30.11.2024 and the name of the petitioner was mutated in Revenue records for the said land.
4 The same can be seen from the adangals which are enclosed by the petitioner along with his affidavit. Hence, the allegation of the petitioner that there is no action of the 3rd respondent on his application is not correct and false. It is further submitted that Chandavaram Village is a Re-Survey completed Village and Government have taken decision for issue of New Model Pattadar Passbooks to all the Khatadars of the Re-Survey completed villages. Accordingly, New Model Pattadar Passbooks are received to this office and the same will be distributed in Gramsabhas as per the Guidelines of the Government.”
3. As seen from the written instructions dated 23.07.2025, the name of the petitioner was mutated in the revenue records. Hence, the relief claimed in the writ petition was granted/redressed by the respondent authorities.
4. Taking into consideration of the written instructions, dated 23.07.2025, the Writ Petition is closed. However, the respondents are
directed to issue pattadar passbooks in the name of the petitioner as expeditiously as possible. There shall be no order as to costs.
As a sequel thereto, miscellaneous Petitions pending, if any, shall stand closed.
