1. The petitioner in this petition has challenged a Government Resolution dated 11.08.2025, claiming that the same has been issued only on the basis of requests made by a Member of Legislative Assembly and it has political overtones. It is further contended that on earlier occasions also proper inquiries have been conducted by officers of the respondent – State and there is no case of encroachment found by such officers.
2. But, we have perused the said Government Resolution dated
11.08.2025. It constitutes a Special Investigating Team (SIT) for the purposes of inquiring into illegal encroachments in service roads at Pathri, Dist. Parbhani. The Government Resolution also gives the terms of reference to the SIT. 2025:BHC-AUG:23985-DB

3. We do not find that the aforesaid Government Resolution in any manner singles out a particular individual, much less the petitioner. As noted herein above, it pertains to alleged illegal encroachment in service roads at Pathri, Dist. Parbhani.
4. We are of the opinion that the SIT constituted under the said Government Resolution, would certainly follow all principles of natural justice while undertaking action in terms of the said Government Resolution by issuing notices to all persons, who may be affected by such an enquiry, including the petitioner herein. After giving due notice to all parties likely to be affected by such an inquiry, the SIT will proceed on the basis of said Government Resolution.
5. These observations sufficiently take care of any anxieties that the petitioner may have about the manner in which the SIT would act under the said Government Resolution dated 11.08.2025. Hence, with these observations the writ petition is disposed of. The petitioner is at liberty to serve a copy of this order on all the respondents.
