Mr. Sunder Dhauni, Advocate for the petitioner. Mr. Ganesh Kandpal, Deputy Advocate General for the State. Petitioner seeks directions to the respondent no. 2 to consider and decide the application dated 23.10.2024, Annexure 4 to the writ petition, submitted by the petitioner. It is the claim of the petitioner that due to mining activities done by the respondent no. 4, cracks have developed in the house of the petitioner. The petitioner had, on multiple occasions, approached the District Magistrate, Pithoragarh, but no action has been done. It is really a very serious issue. If a person claims that due to mining activities, his house has developed cracks, it is incumbent upon the authorities to look into this aspect and examine the impact of such mining activities and thereafter pass an
order, as is permissible under the law. Be that as it may, learned State Counsel gives a statement that within a month, the application, annexure no. 4, submitted by the petitioner shall be
disposed of. The Court takes on record the statement made by the learned State Counsel. The respondent no. 2 i.e. the District Magistrate, Pithoragarh shall take a
decision on annexure no. 4 i.e. the application dated 23.10.2024 of the petitioner within a period of three weeks from today after conducting a detail inquiry, particularly the impact of alleged mining activity. The writ petition stands disposed of accordingly.
