In the light of the order dated 07.12.2024, a supplementary affidavit has been filed on behalf of the Respondent C.B.I. through one Raghunath Kumar, son of late Gaja Nand Kumar, O/O Supdt. of Police, C.B.I, A.C.B, VII/2, Karmik Bhawan, Karmik Nagar, P.O.- I.S.M Camps, P.S. Saraidhala, Dist.- Dhanbad by which it has informed that the sole appellant Dharam Deo Ram @ D.D.Ram has died. A photocopy of death certificate of the said Dharam Deo Ram has been enclosed as Annexure-A in the supplementary affidavit on 10.01.2025.
2. From perusal of Death Certificate dated 05.06.2021 issued by the Office of Registrar (Birth and Death), Dhanbad Municipal Corporation, it appears that the sole appellant Dharam Deo Ram had died on 19.04.2021.
3. Thus, this Criminal Appeal No.701 of 2005 has abated against the appellant namely Dharam Deo Ram on account of his death.
4. Under the circumstances, mentioned above and in view of the provision of Section 394 Cr.P.C., this Cr. Appeal (SJ) No.701 of 2005 stands abated against the appellant and stands disposed of.
5. Let the original lower Court Records be sent to the learned Court below by the Office at once.
