Learned counsel for the petitioner submits that the petitioner is the elder brother in law of the victim lady and is in custody for more than 130 days. He has been falsely implicated. The FIR was lodged at a delay of twenty six days. He prays for bail.
Learned counsel for the State opposes the prayer. I have considered the material on record. The reasons for delay in lodging the FIR shall be assessed at the appropriate state of the trial. The petitioner appears to be the principal accused who allegedly ravished the victim lady. Charge sheet has been submitted. Vulnerable witnesses are yet to be examined. Considering the material on record and
2 prima facie involvement of the petitioner in the alleged offence, prayer for bail is rejected at this stage. The bail application is disposed of. Case Diary is returned.
