Heard the parties. Petitioner has been made accused in connection with Complaint Case No.2757 of 2024, for the offences registered under Sections 47(a), 47(b), 47(c) and 55 of the Excise Act, pending in the Court of learned A.C.J.M., Ranchi. On 05.02.2024 at about 1:00 A.M., the Member of Excise Department raided the closed glass factory situated at Badhu Chowk and seized about 6930 liters of liquor from there. It was submitted that the petitioner was neither apprehended at the place of occurrence nor anything was recovered from his possession. It was further submitted that similarly situated co-accused Haidar Ali @ Haider Ali has been granted bail by a Co-ordinate Bench of this Court vide B.A. No.5086 of 2024. Learned A.P.P. has opposed the prayer for bail but admitted that the petitioner was not apprehended at the place of occurrence. In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Ranchi, in connection with Complaint Case No.2757 of
2024.
