1. The present Cr.M.P. has been filed with the following prayer:- I. This Hon’ble Court may kindly be pleased to call for the entire records of the mater for its kind perusal. 2. This Hon’ble Court may kindly be pleased to pass appropriate order quashing and setting aside the FIR No. 162/2021 dated 04.08.2021 registered by the police station Rajendra Nagar, Raipur, Chhattisgarh. 3. This Hon’ble Court may kindly be pleased to pass appropriate order quashing and setting all the proceedings consequent to the FIR No. 162/2021 dated 04.08.2021 registered by the Police Station Rajendra Nagar, Raipur, Chhattisgarh. 4. Any other relief, which this Hon’ble Court, may deem fit and proper, in the facts and circumstances of the case, in the interest of justice.”
2. The petitioner has filed this petition under Section 482 of the
3 Criminal Procedure Code, 1973, (for short ‘Cr.P.C.’) stating therein that the petitioner runs a business of trading of TMT bars, ingots and other ancillary products, having its registered office at Jhansi styled as M/s Rahul Steel. According to the learned counsel for the petitioner that on 25.06.2021, respondent No.2 sent a legal notice to the petitioner demanding Rs.41,68,282/- towards purchase of TMT Bars from him between 01.12.2020 to 18.04.2021, which in- fact was not ordered by the petitioner and replied to the said notice stating that the ledger statement annexed with the notice is false and fake and respondent's No.2 client has hatched a criminal conspiracy in collusion with the transporter and counterfeited forged and fictitious in voices and builty just to blackmail and extort money from him. According to the petitioner, subsequently respondent No.2 filed the impugned FIR against the petitioner. The further contention of the petitioner is that the allegation levelled against the petitioner in the FIR do not demonstrate the ingredient to constitute an offence under Section 420 IPC. Respondent No.2 has not disclosed any malafide from the inception to show the dishonest intent of the petitioner in cheating him. Thus, the delayed FIR is an afterthought and an abuse of the process of law and any action by the respondent No.1 in pursuance of registration of FIR would be nothing but to harass the petitioner and violation of his fundamental right for no fault on his part. 3.
At the very outset, learned counsel for the parties submits that
4 mediation dated 16.07.2025 between the parties is successful. The mediation report is on record. 4. For the sake of convenience, it would be appropriate to reproduce the contents of mediation report dated 16.07.2025 which reads as under:- This mediation proceeding has been held according to the direction of Hon'ble the High Court of Chhattisgarh as per
order dated 01.07.2025 passed in CR.M.P. No. 936/2021 (Vinod Agrawal vs. State of Chhattisgarh). According to the procedures/processes of mediation, the joint sessions and separate sessions have taken place in the mediation centre of High Court of Chhattisgarh, Bilaspur on 10.07.2025 and thereafter on 14.07.2025 and finally on 16.07.2025 and the parties have been facilitated to arrive at a solution. Now, the parties have arrived at a final conclusion and hence the matter has been settled upon the terms to which the parties agree with their full consent. The terms of settlement to which the parties have agreed are as follows: 1) That the Second Party had filed a case against the First Party and Third Party under Section 420/34 IPC on 04.08.2021 at Police Station Rajendra Nagar, District Raipur, Chhattisgarh, registered as Crime No. 162 of 2021. Against this, the First Party filed CR.M.P. No. 936/2021 under Section 482 CrPC before the Hon'ble High Court of Chhattisgarh. 2) That the Third Party had filed a case against the Second Party bearing Crime No. 262 of 2021 under Sections 420, 467, 468, 471 IPC at Police Station Baragaon, District Jhansi, in which after filing the chargesheet, the Second Party filed Petition No. 18867 of 2023 under Section 482 CrPC before the Hon'ble High Court Allahabad, and on 07.08.2023, the Hon'ble Court stayed the cognizance taken by the court of Hon'ble Additional Civil Judge (JD) Court No. 5, Jhansi, and the petition is pending
consideration in the Hon'ble High Court Allahabad. 5 3) That all three parties are respected and peaceful citizens of their respective cities and society. 4) That all three parties, being reputed businessmen and respected citizens, have resolved all misunderstandings mediation at ADR Centre, Hon'ble High Court, Bilaspur, Chhattisgarh and do not wish to pursue any further legal proceedings against each other. 5) That all trade-related transactions among the three parties have been resolved and there is no pending financial liability between them. 6) That all three parties wish to end all proceedings and maintain mutual harmony to lead a happy and stress-free life, and will support each other in ending the cases and will not indulge in any litigation against each other in the future. 7) That under this mutual compromise, the Second Party has no objection if the Hon'ble High Court of Chhattisgarh, quashes the case registered by the Second Party against the First Party and Third Party, i.e., Crime No. 162/2021 Police Station Rajendra Nagar, District Raipur, Chhattisgarh under Section 420/34 IPC in Cr.M.P. No. 936 of 2021 under Section 482 CrPC on the basis of this compromise. 8) That under this mutual compromise, the Third Party has no objection if the Hon'ble High Court Allahabad, U.P. quashes the case registered by the Third Party against the Second Party, i.e., Crime No. 262/2021 Police Station Baragaon, District Jhansi under Sections 420, 467, 468, 471 IPC in Petition No. 18867 of 2023 under Section 482 CrPC on the basis of this compromise. 9) That all three parties shall not file any kind of legal proceedings against each other in the future and thus will cooperate with each other to ensure the closure of the pending legal cases against each other. 10) Hence, this compromise agreement is being written today, dated 16.07.2025 at High Court Premises, Bilaspur, Chhattisgarh, by all three parties in the presence of witnesses, with full consciousness, after reading, listening, and
6 understanding, without any pressure or influence of intoxication, with a sound mind, so that it may be preserved and used when necessary. 11) The parties agree to abide by the terms as settled on their own will and the terms of settlement has read over to the parties and further explained in Hindi also and only thereafter they have signed this agreement by their own free will and in presence of each other. 5.
In view of the above submission made by the counsel and looking to the mediation report itself that mediation is successful, this CRMP is allowed subject to fulfillment of terms and condition of the settlement enumerated in the mediation report dated 16.07.2025 and accordingly FIR No. 162/2021 dated 04.08.2021 registered by the Police Station Rajendra Nagar, Raipur, Chhattisgarh and all the proceedings consequent to the said FIR under Section 420 of the IPC is here by quashed.
