2. This application has been filed under Section 483 BNSS, seeking bail of the petitioner, namely, Hemen Talukdar, who was arrested on 19.06.2025 in connection with Nalbari P.S. Case No. 202/2025 under Sections
Page No.# 2/2 109/328/103(1)/117(2)/329(3)/3(5) of BNS, 2023.
2. TCR has call for has been received.
3. The allegation against the present petitioner is that he along with his wife trespassed into the residential campus of the informant and assaulted her husband and son with iron rod, as a result of which both of them sustained grievous injuries on their head and out of the two injured persons her husband succumbed to the injuries.
4. The charge-sheet has already been laid and the charges under Section 103/109/329(3)/115(2)/238(3)(5) have already been famed by the learned Sessions Court and the case is fixed for evidence. Having gone through the TCR, there is sufficient incriminating material against the present petitioner including the eye witnesses accounts fully implicating the present petitioner.
5. Having regard to the above, as well as the grave nature of the allegations, the prayer for bail is rejected at this stage.
6. The petition stands dismissed accordingly.
