GP FOR HOME The Court made the following: 2 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.273 OF 2019 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: “….issue a writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents particularly 3rd respondent in harassing the petitioner in various modes without registering any crime against the petitioner as illegal, unjust, arbitrary, highhanded, malafied and discriminative and against statutory provisions and consequently direct the respondents not to harass the petitioner in the absence of any crime against the petitioner and pass…” 2. Heard Sri L.J.Veera Reddy, learned counsel for the writ petitioner and learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader on written instructions would submit that the allegations in the affidavit that police calling the petitioner to the police station, and harassing him is not true and correct. On the other hand, police registered two cases against the petitioner in Crime No.135 of 2009 for the offence under Section 9(1) of A.P. Gaming Act and Crime No.242 of 2019 under Section 353 IPC and Section 9(1) of A.P. Gaming Act relating to cricket betting and in that connection, he was asked to attend police station for enquiry. 4. Considering the above facts and circumstances, this Court is of the considered opinion that the writ petition can be closed at the stage of admission, without going into merits of the case, observing that police shall follow due procedure established by law, if they intends to 3 call the petitioner to the police station in connection with investigation of the above two crimes. 5. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
