On 07.03.2025, the petitioner made an application for reissuance of passport. During poNce verification, the petitioner came to know that Sri Gaddam Khaja Hussain, SI of Tadipatri Police Station, has given complaint against the petitioner and nine others. 2. nd Town and Mandal. The 2 3. Learned counsel for the petitioner submits that the matter is still in FIR stage and sought for renewal of passport. Learned counsel for the petitioner relied on the decisions of the Hon’ble Apex Court in Maneka Gandhi v. Union of India^ and Mohan C. Lazarus v. Regional Passport Officer^, wherein it ’(1978) 1 see 248 : AIR 1978 Se 597 ^ 2021 see Online Mad 8142 4 X was held that the right to travel abroad is the personal liberty enshrined under Article 21 of the Constitution of India and sought for renewal of his passport. 4. Learned Assistant Government Pleader, appearing on behalf of the respondents, on instructions, submits that the matter is still at FIR stage. ^s the matter is still in the FIR stage and no final report has been filed till date, it cannot be held that criminal proceedings are pending against the petitioner. The criminal proceedings commence only after a final report is filed ■ before the concerned Court and the same is taken cognizance. 5. In view of the above discussion, the Writ Petition is disposed of at the stage of admission, directing the 2'"'^ respondent to renew/reissue the passport of the petitioner for the regular period for which it is renewed for others as per the Rules, within four (4) weeks from the date of receipt of a copy of this order. The petitioner is directed to make a fresh representation to the 2"*^ respondent along with all the relevant documents and a copy of this order.
