THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, the petitioner seeks for the following reliefs: "WHEREFORE it is respectfully prayed that this Hon'ble Court be pleased to quash the criminal proceedings in C.C.No.2174/2018 (Crime No.235/2017) of the Koramangal Police against the Petitioner for the offences punishable under Section 385 read with Section 34 of Indian Penal Code in file of XXXIX Additional Chief Judicial Magistrate, Bangalore, to serve the interest of justice and equity." 2. After arguing the matter for some time, the learned counsel for the petitioner submits that the Trial Court has issued proclamation and attachment warrant against the - 3 - HC-KAR NC: 2025:KHC:20517 CRL.P No. 7198 of 2025 petitioner/accused No.1 under Sections 82 and 83 of Criminal Procedure Code and the same may be set aside, pursuant to which, the petitioner would appear before the Trial Court on the next date of hearing of C.C.No.2174/2018 which presently stands posted to tomorrow i.e., on 17.06.2025. It is further submitted that the Trial Court may be directed to dispose of the main proceedings as expeditiously as possible, within the stipulated time frame by setting aside the proclamation and attachment warrant. 3. The said submission is placed on record. 4. In view of the aforesaid facts and circumstances and submissions made by the learned counsel for the petitioner, petition deserves to be disposed of with certain directions to the Trial Court. 5. In the result, I pass the following: ORDER i. The petition is disposed of. ii. The proclamation and attachment warrant issued against the petitioner/accused No.1 by the Trial Court in C.C.No.2174/2018 on the file of XXXIX Additional - 4 - HC-KAR NC: 2025:KHC:20517 CRL.P No. 7198 of 2025 Chief Judicial Magistrate, Bengaluru are hereby set aside, subject to the condition that the petitioner shall appear before the Trial Court on 17.06.2025. iii. The Trial Court is directed to conclude the proceedings and dispose of the case within a period of six months from 17.06.2025. iv. It is made clear that all rival contentions on all aspects of the matter are kept open and no opinion is expressed on the merits/demerits of the same. v.
