The applicant has preferred this anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 113/2025, registered at Police Station – Basantpur, District – Rajnandgaon (C.G.) for alleged commission of offence punishable under Sections 317(2), 317(4), 317(5), 111, 3(5) of the Bharatiya Nyaya Sanhita, 2023 (BNS). 2. As per the prosecution story in brief, is that a written complaint filed by In- charge of the Cyber Cell, District Rajnandgaon, submitted a written complaint to the Basantpur Police Station, the complaint stated that, RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 based on instructions from senior officials and information from the Indian Cyber Crime Coordination Center's portal, six Axis Bank accounts in Rajnandgaon (IFSC code UTIB0000521) were found to have deposits totaling Rs. 27,32,900/- obtained through cyber fraud, the accounts were 922010046624545, 922020060311484, 922010031856537, 922020060311295, 923010020887192, 923010052339838, the account holders/promoters allegedly used the money received from cyber fraud, based on the complaint, the Basantpur Police Station registered a case against the account holders as well as the applicant. Hence, this application. 3. The learned counsel for the applicant has argued that the applicant is completely innocent and further submitted that the co-accused persons have been granted regular bail by this Court vide orders dated 07.05.2025 and 20.05.2025 passed in MCRC Nos. 3520/2025 and 3917/2025. Therefore applicant is entitle for grant of bail. 4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submitted that, it transpires that based on instructions from senior officials and information from the Indian Cyber Crime Coordination Center's portal, six Axis Bank accounts in Rajnandgaon (IFSC code UTIB0000521) were found to have deposits totaling Rs. 27,32,900/- obtained through cyber fraud, the accounts were 922010046624545, 922020060311484, 922010031856537, 922020060311295, 923010020887192, 923010052339838, the account holders/promoters allegedly used the money received from cyber fraud, based on the complaint, the Basantpur Police Station registered a case against the account holders as well as the applicant, 3 and it appears to be an online fraud. Therefore, the present anticipatory bail application of the applicant is liable to be rejected. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts & circumstances of the case, allegations levelled against the applicant in the FIR, and from the perusal of the records available, it transpires that it transpires that based on instructions from senior officials and information from the Indian Cyber Crime Coordination Center's portal, six Axis Bank accounts in Rajnandgaon (IFSC code UTIB0000521) were found to have deposits totaling Rs. 27,32,900/- obtained through cyber fraud, the accounts were 922010046624545, 922020060311484, 922010031856537, 922020060311295, 923010020887192, 923010052339838, the account holders/promoters allegedly used the money received from cyber fraud, based on the complaint, the Basantpur Police Station registered a case against the account holders as well as the applicant, and it appears to be an online fraud, thus, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the Anticipatory Bail application of the applicant – Arvind Soni, filed under Section 482 of the BNSS, 2023 in connection with Crime No. 113/2025, registered at Police Station – Basantpur, District – Rajnandgaon (C.G.) for alleged commission of offence punishable under Sections 317(2), 317(4), 317(5), 111, 3(5) of the BNS, is rejected.
