This application has been filed under section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, whereby the accused petitioner namely, Nabajyoti Sonowal, has prayed for bail in connection with Morigaon P.S. Case No. 268/2025 under Section 108 of BNS, 2023. 3. The petitioner was arrested on 31.10.2025. 4. The FIR dated 31.10.2025 lodged by the sister of the victim/deceased alleging that on 19.10.2025 in the afternoon, her said sister aged 19 years committed suicide. It is also alleged that there was a love affair of her sister with the accused person since one and half years and that the accused mentally tortured her over phone and made demands and threats and therefore, her sister died. 5. The learned counsel for the petitioner submits that he was arrested on 31.10.2025 and already spent 48 days in custody; he is a student aged 20 years. It is also pointed that there was 11(eleven) days delay in filing the FIR which has not been explained. 6. The learned Additional Public Prosecutor submits that investigation has revealed from the testimony of some witnesses that the petitioner and the deceased had a love affair but that, he used to assault her sometime in public place. Upon a query from the court, the learned Additional Public Prosecutor submits that investigation so far has not revealed any materials relating to viralling of personal/private photographs and/or any blackmailing regarding the same. 7. In the given facts and circumstances; considering progress in the investigation; considering the length of detention, he can be released on Page No.# 3/3 bail at this stage, subject to conditions. 8. Accordingly, the accused-petitioner, named above, shall be released on bail in connection with Morigaon P.S. Case No. 268/2025 under Section 108 of BNS, 2023, on furnishing bail bond of Rs.20,000/- with one suitable surety of the like amount to the satisfaction of learned concerned court. 9. The direction for bail is further subject to the following conditions: (a) That the petitioner shall be available for the remaining investigation; (b) That the petitioner shall not hamper or tamper with evidence; and (c) That the petitioner shall not intimidate or harass the family members of the victim. 10. Violation or breach of any condition(s) shall entail cancellation of bail. 11. With the above observations, this bail petition stands allowed and disposed of accordingly. 12.
