ORAL ORDER
Heard learned counsel for petitioner and learned counsel for respondent.
2. The parties, namely, Smt.Snehal Dure P. and Sri Sachin S. are present before the Court physically. They together submit that they have entered into memorandum of settlement before the Karnataka Mediation Centre with regard to resolving the dispute between themselves; withdrawing of the petitions filed against the respondent and the in-laws arising out of the matrimonial differences between them and so also, the custody and visitation rights to be retained with the mother and permanent alimony, educational expenses and marriage expenses to the minor child.
3. The said memorandum of settlement entered into between the parties before the Karnataka Mediation Centre, is placed on record.

4. In view of the parties having settled their dispute amicably by way of entering into the memorandum of settlement before the Karnataka Mediation Centre in accordance to the terms and conditions stated therein, this petition would no longer survive for consideration.
5. The parties shall abide by the terms and conditions stipulated in the memorandum of settlement. It is seen that the proceedings in MC.No.7365/2023 initiated by the respondent are pending on the file of IV Additional Principal Judge, Family Court, Bengaluru. In view of the memorandum of settlement entered into by the parties voluntarily, the Family Court shall pass the order of dissolution of marriage by recording the same upon parties appearing before the Court so also the parties shall comply with the terms as stated in para-7 of the memorandum of settlement diligently without breach or violation.
6. This Court enquired with both parties, who are present before the Court, as to whether they have entered into memorandum of settlement to resolve the dispute

between themselves by putting an end to the matrimonial dispute, to which, they have answered in the affirmative. They also submit that they are not been coerced or forced to agree to this memorandum of settlement and the terms stipulated therein and they have voluntarily executed and signed the memorandum of settlement out of their own free will and consent, without any coercion.
7. In view of the above, I pass the following:
ORDER i) The petition is disposed off in terms of the memorandum of settlement entered into between the parties before the Karnataka Mediation Centre; ii) The parties shall comply the terms and conditions of the memorandum of settlement; iii) The terms and conditions of the memorandum of settlement shall be made as part of this order, as the parties have agreed to settle the dispute amicably.

In view of disposal of the petition, pending Interlocutory Application, if any, does not survive for
consideration and the same pales into insignificance.
