BEFORE HONOURABLE MR. JUSTICE ANJAN MONI KALITA ORDER 04.12.2025 Heard Mr. L.R. Mazumder, the learned counsel for the accused – applicants. Also heard Mr. B. Sarma, the learned Additional Public Prosecutor appearing for the State. 2. This is an application under Section 482 of BNSS, 2023 for granting pre- arrest bail to the accused – applicants in connection with Lakhipur P.S. Case No. 54/2025 corresponding to GR Case No. 72/2025 under Sections 296 / 351(2) / 329(3) / 117(2) / 118(1) / 74 / 3(5) of BNS, 2023. 3.
The allegation as narrated in the FIR dated 18.04.2025 is mainly two groups of people got into a fight and during the fight, it was alleged that some of the persons from the informant side got injured. On receipt of the FIR, the aforesaid Lakhipur P.S. Case No. 54/2025 has been registered under the aforementioned Sections. 4. Vide an order dated 25.07.2025, a Coordinate Bench of this Court granted interim pre-arrest bail to the accused – applicant nos. 5 to 10. The learned Additional Public Prosecutor has submitted that in the meantime, the Charge Sheet in the instant case has already been filed vide C.S. No. 94/2025 dated

24.08.2025. 5. In view of the aforesaid submission, the learned counsel appearing for the accused – applicants submits that the accused – applicants may be allowed sometime to appear before the learned Trial Court for appropriate relief. 6. In view of the aforesaid, this Court extends the interim pre-arrest bail granted to the accused – applicant nos. 5 to 10 till their appearance before the learned Trial Court, within 10(ten) days of passing of the instant order. So far as the accused – applicant nos. 1 to 4 are concerned, they may have the liberty to approach the learned Trial Court for appropriate relief. 7. In view of the aforesaid interim order passed in favour of the accused – applicant nos. 5 to 10 is extended as mentioned above. 8. Accordingly, the interlocutory application is disposed of.
