Neutral Citation No. - 2025:AHC:33436-DB Court No. - 29 Case :- WRIT - C No. - 6861 of 2025 Petitioner :- Smt. Shiv Kumari Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Rawati Raman Pathak Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Petitioner's claim for payment of compensation under the Disaster Relief Scheme appears to have been denied consideration only on the ground that the post mortem report does not specify the cause of death. Viscera has been preserved. Learned counsel for the petitioner states that various materials as well as police report conclusively established the fact that the cause of death was snake bite. Reliance is also placed upon a Government Order dated 08.07.2021, according to which there is no requirement of waiting for the viscera report and that relief be made available within a period of 7 days. It is submitted that the object of the scheme itself would be frustrated in the manner such claims are kept pending. Learned Standing Counsel states that the case of the petitioner would got re-examined by the District Magistrate- Mirzapur. In that view of the matter, we dispose of this writ petition with a direction upon second- respondent to accord consideration to petitioner's claim in light of the above observations by passing appropriate reasoned orders within a period of four weeks. The petitioner shall be at liberty to annex all materials in support of such claim together with a copy of this order before the second- respondent.
