The above Writ Petition has been filed seeking, inter alia, to quash certain conditions in the Request For Proposal bearing reference No. KPTCL/CEE- SLDC/SEE-SCADA/MDF-012/2024-25 dated 24.4.2025 being a tender for "Selection Agency for Monetization of Dark Fibre and Operation & Maintenance of OPGW Network of KPTCL of 6119 Kms" ("Tender"). 2. It is submitted that since all the bidders who participated were disqualified in the E-Portal itself, there was no bidders and evaluation of bids has been suspended by the E-Portal itself. Hence the Tender has been cancelled and EMD has been refunded. The Petitioner has also collected the EMD. 3. The Official Memorandum dated 28.5.2025 bearing number CEE/SLDC/SEE-SCADA/EE- MIS/2025-26/850-57 cancelling the Tender is produced herewith as Document No.1. 4. In view of the above, the Writ Petition has become infructuous and the same may be disposed as having become infructuous."
